Acceptable Use Policy (AUP)
1. General
- This Acceptable Use Policy (AUP) sets out rules for Users when using Guru VPN services and software (the “Service”, “Services”). It is an integral part of the Terms of Service.
- You must use the Service only for lawful purposes and in accordance with this AUP, the Terms of Service and applicable law.
- This AUP should be read together with our Terms of Service, Privacy Policy, No-Logs Policy, and Fair Usage Policy (FUP).
2. Prohibited conduct
- You must not use the Service to commit, facilitate or assist any activity that directly or indirectly:
- Violates applicable law in any jurisdiction, including international law.
- Distributes, posts, transmits, stores, accesses or makes available content through or using the Service that includes:
- child sexual exploitation material (CSEM) or any material sexualizing minors;
- material that promotes or glorifies violence, terrorism or extremism;
- content that violates third‑party privacy or exposes confidential/commercial secrets.
- Engages in, facilitates or assists computer attacks or abusive security conduct. For clarity, any technical detection of such activity is limited to configured IDS/IPS signatures, network-level patterns, infrastructure signals and/or external reports; we do not conduct full traffic-content analysis and do not guarantee detection of every malware, phishing, scanning or abuse event. Examples include:
- DDoS attacks, port scanning, unauthorized access, exploitation of vulnerabilities;
- distribution, storage or operation of malware (viruses, trojans, miners, exploits, etc.);
- phishing, social engineering, credential theft.
- Sends spam, bulk unsolicited commercial messages, chain letters or other intrusive marketing without recipients’ consent.
- Uploads, distributes or makes available copyrighted or other IP‑protected material without proper rights or authorization.
- Uses the Service for fraud, money laundering, sale of stolen goods/data or for trading illegal goods or services.
- Attempts to bypass, neutralize or otherwise defeat Service security mechanisms, abuse prevention, limits or blocks.
- Violates the Fair Usage Policy (FUP), including exceeding permitted registered-device limits, engaging in excessive use that materially degrades service for others based on available technical indicators, or abusing trial/promotional offers.
- Uses the Service for automated mass data collection (crawling, scraping) without prior consent where this infringes third-party rights or places excessive load on infrastructure. Our ability to identify such activity is limited to available indicators, such as anomalous network patterns, infrastructure impact, external complaints, and other abuse signals; we do not guarantee precise identification of all crawling or scraping activity.
- Publishes or transmits defamatory, discriminatory, harassing or otherwise unlawful content.
3. Logs, privacy and law‑enforcement cooperation
- While we publicly state a minimal-logging privacy posture, no-logs does not mean that we process no data at all. We may process limited technical information necessary to investigate abuse, such as user-linked connection logs retained under the applicable period, registered-device limit status, approximate data volume, IDS/IPS signature- or pattern-based security alerts, error rates, infrastructure impact indicators, and external complaints, to the extent permitted by applicable law and our Privacy Policy. Any data processed for investigation purposes is handled in accordance with our Privacy Policy and No-Logs Policy and is retained, deleted, anonymised, or aggregated under the applicable retention rules, unless longer retention is required or permitted for legal, security, abuse-prevention, billing, lawful-request, or legal-claims purposes.
- We do not perform full traffic-content monitoring or inspect the content of user communications. For suspected abuse or in response to lawful process, our technical assessment is limited to available service metadata, user-linked connection logs retained under the applicable period, external complaints, and IDS/IPS systems that check configured traffic signatures and network-level patterns for suspicious or malicious activity. IDS/IPS alerts may include technical indicators and internal device identifiers where necessary for security, abuse-prevention, or lawful-request handling, but this does not involve maintaining browsing histories or retaining traffic content as user activity logs.
- We may disclose information to competent authorities in response to lawful requests, orders or judicial process, but only to the extent required by law and only where the requested data exists, can be lawfully accessed, and can be lawfully disclosed.
4. Moderation and response measures
- Detection. We may use limited automated security tools, including IDS/IPS systems based on configured traffic signatures and network-level patterns, user-linked connection logs retained under the applicable period, registered-device status, available service metadata, infrastructure impact indicators and/or third-party complaints to identify potential violations. Such detection is not exhaustive and does not guarantee identification of every prohibited activity.
- Remedial measures. Where available security alerts, service metadata, infrastructure signals, external complaints or other reasonable grounds indicate a potential violation of this AUP, we may, at our discretion and without prior notice:
- temporarily suspend User access to the Service;
- limit account functionality;
- block or restrict specific connections, suspicious traffic flows, servers or Service features where reasonably necessary based on available technical signals or other reasonable grounds;
- suspend or terminate subscriptions;
- refer matters to law‑enforcement or commence civil proceedings.
- Temporary blocks may remain in place pending internal investigation or resolution by competent authorities.
- Enforcement decisions take into account severity of violation, account history and potential harm to third parties.
5. Complaint and appeal procedure
- Filing a complaint. Any party may report a suspected AUP violation to support@guruvpn.com or privacy@guruvpn.com. Complaints should include sufficient detail to identify the incident (description, date/time, screenshots, links, contact for follow‑up).
- Review. We will review complaints in a reasonable timeframe, generally within 14 business days, and may request further information. We will take appropriate action based on our review.
- 5.3. Appeals. If you believe enforcement action against you was erroneous, submit an appeal to support@guruvpn.com or privacy@guruvpn.com within 14 days of the enforcement action. We will reconsider and, if we find an error, lift or modify the measure. We aim to respond within 14 business days.
- Timing. In emergency cases involving imminent risk of serious harm we may act immediately without awaiting standard procedural timelines.
6. User liability and indemnification
- You are fully responsible for complying with this AUP and all applicable laws when using the Service.
- You agree to indemnify and hold us and our affiliates harmless from any losses, claims, damages, liabilities and costs (including reasonable attorneys’ fees) arising from your violation of this AUP or use of the Service in violation of law or third‑party rights.
7. Enforcement measures and safeguards
- We reserve the right to take reasonable technical, administrative and legal measures to prevent and stop AUP violations.
- Measures may include abuse signal monitoring, IDS/IPS signature- or pattern-based protective actions, temporary connection or feature restrictions, bandwidth restrictions, firewall rules at the infrastructure level, and other protective actions. We do not rely on stored real user source IP addresses or user-level concurrent connection counts as standard account-enforcement data.
- We are not liable for direct or indirect losses to Users or third parties resulting from enforcement actions taken in good faith and in accordance with this AUP.
8. Updates and changes to the AUP
- We may amend this AUP from time to time. Updated versions will be published at our website, legal/policy page, account dashboard, app legal section, or any other official publication location; the document will indicate the date of last update.
- Continued use of the Service after publication of changes constitutes acceptance of the updated AUP.
- For material changes we will strive to notify Users in advance by email, in-app notice, website notice, account dashboard notice, push notification, or any other reasonable communication method where reasonably practicable.
